1. Purpose
These Terms of Use govern access to and use of the Prospenso platform, published by Victor Marion, sole proprietor: a B2B email prospecting service for professionals.
2. Account and access
Registration is reserved for professionals (B2B). Users are responsible for keeping their login details confidential and for all activity carried out from their account and workspaces.
3. Acceptable use
Users undertake to comply with the regulations applicable to email prospecting, in particular: B2B prospecting related to the recipient's professional role, inclusion of the unsubscribe link (inserted automatically by the platform), compliance with objection requests and an accurate sender identity. The following are prohibited in particular: spam, identity theft, sending to non-compliant purchased lists and any unlawful content.
4. Availability
The service is provided “as is”. The publisher endeavours to ensure continuous availability but does not guarantee it. Email deliverability depends on external factors (sender domain reputation, recipients' filters) and is not guaranteed.
5. Suspension and termination
The publisher may suspend an account in the event of a breach of these Terms of Use, in particular abusive use of the sending service. Users may cancel at any time from the billing portal; access remains active until the end of the paid period.
6. Liability
Users remain solely responsible for the content of their campaigns and for the compliance of their prospect lists. The publisher's liability is limited as set out in article 11 of the Terms of Sale.
7. Governing law
These Terms of Use are governed by French law. Any dispute falls within the jurisdiction of the competent courts of Rennes, France.
